3 Tips Before Buying Property with A Boyfriend or Girlfriend

One of the most common fact patterns we see in our real estate litigation practice is an ex-boyfriend, ex-girlfriend, ex-fiancée, or ex partner who purchased property and then broke up with their relationship partner.   The relationship break up also typically means that there has to be a break up with respect to the jointly owned property.   Here are a few things to consider before buying property with a significant other: 1. Do you have a plan if the relationship does not work out? We suggest discussing this ahead of time. 3 Common Deeds For Real Property

The purchase of real property generally comes with some type of warranty deed. Warranty deeds provide a certain extent of protection against defects in title.  Three of the most common types of deeds are: General Warranty Deeds and Grant Deeds; Limited Warranty Deeds; and Non-Warranty Deeds. General Warranty Deeds (Grant Deeds) In a General Warranty Deed, the seller usually gives four warranties regarding the land to the buyer.  Specifically, the seller warrants to the buyer that: The seller has the right to convey the real estate; The seller will defend the title to the real estate against the claims of all persons; The seller has proper “seisin.”  Seisin basically means that the seller warrants that the seller owns all of the rights in the real estate; and

Quitclaim Deed Fraud

According to a recent ABA Journal article, some Court clerks are developing methods to deal with quitclaim deed fraud.  Specifically, the ABA notes that: Anyone who wishes to generally can file a document at the county courthouse, and most property owners likely would have no idea that a fraudulent claim to ownership had been made. However, some court officials are starting to develop new systems intended to protect those targeted in such schemes, which are much more common than they used to be.
