Zachary Schorr Quoted on Realtor.com!

Earlier last week, Realtor.com quoted our Lead Trial Attorney Zachary Schorr when he provided  legal commentary on Deed Restrictions. The article, titled Building, Buying, or Beefing Up a Home? Watch Out for Annoying Deed Restrictions, talked about watching out for “annoying” restrictions on real property.   In particular, the article discusses finding out about deed restrictions, who typically enforces deed restrictions, how to change a deed restriction, and lastly what to do if you can’t change that restriction. 5 Things to Know about a Transfer on Death Deed (TOD)

On January 1, 2016 Assembly Bill 139 went into effect in California allowing a non-probate method for conveying real property upon death, now known as a Revocable Transfer on Death Deed (“TOD Deed”).  This deed is really just a future conveyance that provides that a certain person will get the property upon their transferor’s death. 3 Common Deeds For Real Property

The purchase of real property generally comes with some type of warranty deed. Warranty deeds provide a certain extent of protection against defects in title.  Three of the most common types of deeds are: General Warranty Deeds and Grant Deeds; Limited Warranty Deeds; and Non-Warranty Deeds. General Warranty Deeds (Grant Deeds) In a General Warranty Deed, the seller usually gives four warranties regarding the land to the buyer.  Specifically, the seller warrants to the buyer that: The seller has the right to convey the real estate; The seller will defend the title to the real estate against the claims of all persons; The seller has proper “seisin.”  Seisin basically means that the seller warrants that the seller owns all of the rights in the real estate; and
